Terms and Conditions

Customer understands and/ or acknowledges and/ or authorizes:

Any contract/ job under $1000 must have a credit card on file with Green Side Up Estate Management (GSUEM) to charge upon completion of work or be paid in full with a pre-approved check prior to work commencing. Maintenance jobs (such as mowing or plowing) must have a valid credit card on file, or have a pre-payment via a punch pass. Payment for any contract/ job over $1000: One half (1/2) down and one half (1/2) the day of completion of the job. A current credit card (Visa, MasterCard, Discover, American Express) must be kept on file with GSUEM. All charges are due and payable in full immediately after services are rendered. All disputes of charges must be raised within ten (10) days from the date of the invoice to be considered for any adjustments. A $40 fee will be applied for any returned check. A late payment/ finance charge of 1.5% per month (18% per annum) will be applied to all unpaid balances exceeding 30 days and all services will be placed on hold until payment in full has been received and a punch pass purchased with a valid credit card placed on file to secure future payment. A collection fee of $400 will be added per property(s) to any unpaid balances exceeding 60 days. A mechanics lien will be filed on the property(s) for any unpaid balances exceeding 90 days, including accrued finance charges, collection fees, administrative fees, delivery and recording fees.   

GSUEM is authorized to use any images from your property in promotional or advertising materials. GSUEM is authorized to use email addresses to send all correspondence, including promotional/ advertising materials from GSUEM. Under no circumstances does GSUEM share your information without your written consent. The contract/ job constitutes the entire agreement between the parties relating to the subject matter of the contract/ job. The contract/ job supersedes all prior negotiations, representations or undertakings, whether written or verbal, except that this condition shall not exclude liability in respect of any fraudulent misinterpretation.    

Summer Work: Summer maintenance will begin when the weather permits, generally around April 15th. The quoted rate for mowing is for weekly mowing only. If a customer prefers every other week mowing (every 14 days), the rate will be 1.5 times the weekly rate. Any grass over 5” will be billed at time and materials. For every other week mowing, customer understands that there will be grass clippings. Clippings can be raked and removed for an additional fee. Customer understands that for the health of your lawn, GSUEM uses mulching mowers. Customer understands and agrees that by entering into a mowing agreement with GSUEM, it is Customer’s responsibility to ensure that the lawn is ready to be mowed on your scheduled day. This includes making sure your sprinkler system is set to not run on mow days. Customer understands that GSUEM will not mow if the lawn is too wet to prevent damage to the turf. If sprinklers prevent the lawn from being mowed, customer will still be billed for their weekly service. Customer also understands that it is their responsibility to move furniture, toys and other obstacles from the area to be mowed on their scheduled day. THIS INCLUDES trash and pet waste. If GSUEM contractors have to perform clean-up prior to mowing, this will be billed to the Customer at $65.00 per man per hour with a one-hour minimum.    

Winter Work: Snow removal service will begin when the snow starts accumulating and ends when the lifts close for the season on Aspen Mountain, or April 15th, whichever comes first. This service does not include any scraping of snow or chipping of ice. Special calls will be billed at $45.00 per man hour, $100.00 per hour for plowing or skid steer work, with one-hour minimum. GSUEM cannot be held responsible for damage to any property or improvements located in or abutting the areas to be plowed/ shoveled which are not clearly marked, such as railroad ties, planters, landscaping areas etc. Gravel and sod will be displaced/ moved by the snowplows. In the event where there is a series of two to three storms where the total accumulation is greater than 5 inches, then GSUEM is authorized to do a "clean up" plow of your driveway at your regular contract amount. If the agreement is received after the first snowfall of the season the first service will be billed at the hourly rate with a one-hour minimum. This agreement may be cancelled without notice and at the sole discretion of GSUEM if payment in full has not been received within ten (10) days of the due date. This agreement will automatically renew and continue in full force and effect from year to year unless cancelled by either party with a thirty (30) day written notice to the address indicated on the contract. Seasonal contracts may cancel only between April 15th and September 15th of any year with thirty (30) days written notice. If a lawsuit is instituted to collect any unpaid balances accruing hereunder, the prevailing party shall be entitled to receive its reasonable attorney fees.
