TERMS AND CONDITIONS
Customer understands and/or acknowledges and/or authorizes: - Any contract under $1000 must have a credit card on file with Intuit/QuickBooks to charge upon completion of work or be paid in full with a check prior to work commencing. - Payment for any contract over $1000: One half (1/2) down and one half (1/2) upon completion of the job. This could be the same day or possibly the next day. - Credit card authorization form, for Visa, MasterCard, or Discover only, must be filled out, signed and kept on file with Intuit/QuickBooks. - All charges are due and payable in full immediately after services are rendered. - A $25 fee will be applied for any returned check. - A late payment/finance charge of 1.5% per month (18% per annum) will be applied to all unpaid balances exceeding 30 days. - A collection fee of $400 will be added to any unpaid balances exceeding 60 days. - A mechanic’s lien will be filed on the property for any unpaid balances exceeding 90 days, including accrued finance charges, collection fees, delivery and recording fees. - GSU/VP is authorized to use any images from your property in promotional or advertising materials. - GSU/VP is authorized to use e-mail addresses to send all correspondence, including promotional/advertising materials, from GSU/VP. - The Contract constitutes the entire agreement between the Parties relating to the subject matter of the Contract. - The Contract supersedes all prior negotiations, representations and undertakings, whether written or verbal, except that this Condition shall not exclude liability in respect of any fraudulent misinterpretation. Summer work: - Summer maintenance will begin when weather permits. Winter work: - Snow removal service will begin when the snow starts accumulating and ends when the lifts close for the season on Aspen Mountain. - This service does not include any scraping of snow or chipping of ice. - Special calls will be billed at $35.00 per man per hour, $95.00 per hour for plowing or skid steer work, with a one-half hour minimum. - If the agreement is received after the first snowfall of the season the first service will be billed at our hourly rate with a one-half hour minimum. - This agreement may be canceled without notice and at the sole discretion of GSU/VP if payment in full has not been received within ten (10) days of the due date. - This agreement will automatically renew and continue in full force and effect from year to year unless cancelled by either party with a thirty (30) day written notice to the address indicated on the contract. - Seasonal contracts may cancel only between April 11th and September 15th of any year, with a thirty (30) day written notice. - If a lawsuit is instituted to collect any unpaid balances accruing hereunder, the prevailing party shall be entitled to receive its reasonable attorney fees. - GSU/VP cannot be held responsible for damage to any property or improvements located in or abutting the areas to be plowed/shoveled which are not clearly marked, such as railroad ties, planters, landscaping areas, etc. - Gravel and sod will be moved/displaced by the snowplows - In the event there is a series of two to three storms where the total accumulation is greater than five inches, then green Side Up/Valley Plowing is authorized to do a “clean up” plow of your driveway at your regular contracted amount. - Terms and Conditions and Standard Exclusions are subject to change without notice.
